The rules that apply to firewood and mulch orders from TB'S Trees, Bendigo. Plain English. Read these before placing an order.
These terms and conditions ("Terms") apply to the firewood and mulch products sold by TB'S Trees through the website at tbstrees.com.au, by phone or by email. Placing an order — through the online cart, by phone, or by email — means you have read these Terms and agreed to be bound by them.
In these Terms, "TB'S Trees", "we", "us" and "our" refer to TB'S Trees, the family-owned arborist business operated by Tom Brinkman and based at Axedale, Victoria. "You" and "your" refer to the customer placing the order.
These Terms apply alongside any specific written agreement we make with you (for example, an emailed delivery quote for an out-of-area suburb). If anything in a specific written agreement is inconsistent with these Terms, the specific written agreement takes precedence for that order only.
Currency. All prices on the website are in Australian dollars (AUD).
Set unit prices. Firewood is sold by the cubic metre (m³). Mulch is sold by the 30L bag, the 5m³ half-load, or the 10m³ full load. The set unit prices are shown on the firewood sales and mulch sales pages. A cubic metre is a stacked-equivalent measure — a 1m × 1m × 1m stack.
Plus GST if applicable. Prices on the website do not include GST. Whether GST is added to your order depends on our current GST registration status. We will confirm GST treatment with you when we confirm your order.
Volume discount on firewood. When the total firewood in your order (across both grades combined) reaches 2m³, the firewood subtotal is discounted by 5%. At 3m³ or more, the discount is 10%. The discount is calculated automatically by the website cart and applies only to firewood — mulch is not part of this discount.
Price validity. Prices shown on the website are valid at the time you place an order. We do not change the price of your order between submission and delivery. We may change website prices at any time without notice; once we have confirmed your order, your price is locked.
A submitted order is a request. When you submit the order form on the cart page, you are asking us to confirm availability and arrange delivery. Your submission is not, on its own, a binding contract. A binding order arises only after we confirm acceptance — usually by a phone call or email reply.
Availability. Both firewood and mulch are by-products of our tree work, so availability and the exact species mix on hand vary through the year. If we cannot supply what you have ordered — for example, if the seasoned firewood you wanted is not currently in stock — we will tell you and offer an alternative or decline the order.
Right to decline. We may decline any order at our discretion, for any reasonable reason. Common reasons include: stock is unavailable; the delivery location is outside our practical service area; access at the property is unsafe; or there is a problem with the payment arrangements.
Confirmation method. We confirm orders by phone or email. The confirmation will state the products ordered, quantities, set prices, any discount applied, delivery fee (see Section 4), GST treatment, payment method and expected delivery window.
Delivery is organised based on your address and the straight-line distance from central Bendigo:
Pick-up. Pick-up from our Axedale yard is available by arrangement at any time. There is no fee for pick-up. Phone us to arrange a pick-up time and to confirm what is currently on hand.
Delivery times are estimates. We agree a delivery day or window with you when we confirm the order. Times are estimates only and may shift due to weather, traffic, breakdowns, or earlier jobs running long. We will let you know if we are running late or need to reschedule.
Day-of communication. We typically call or text on the day of delivery with an updated ETA. If you have provided a mobile number, please keep it available on the delivery day.
You must provide safe, adequate access for our delivery vehicle and crew. This includes:
Tell us in advance about access issues. If your property has unusual access — a narrow driveway, a soft section of ground, a steep slope, low wires, anything we should know — please tell us when you place the order. We can often plan around it, but we need to know.
If access is inadequate on the day, we may need to drop the load at the nearest safe point (for example, on the verge or street) and you carry it from there, or we may need to reschedule. Where we have to reschedule because the access was different to what was advised, a re-delivery fee may apply, equal to the standard delivery fee for your zone.
Damage to driveways and lawns. Heavy trucks impose loads that ordinary garden surfaces are not designed for. Where you have instructed us that access is suitable, you accept the risk of marks on driveways, lawns and other surfaces. We drive carefully and at low speed, but we cannot guarantee no marks, particularly on soft ground or after rain. If you are unsure about a surface, tell us — we will assess on arrival and may suggest dropping the load elsewhere.
Where the load is dropped. We deliver the load to the spot you nominate on your property, provided it is safe and accessible. We do not stack firewood or barrow mulch into a back yard unless specifically arranged and quoted in advance.
Accepted payment methods.
What we don't currently accept: credit or debit card payments, online payment cards, BNPL services, account credit, or invoicing on terms. These may be added in the future.
Receipts. A receipt is provided at delivery or by email on request.
Unpaid orders. Where bank transfer is the agreed method and payment has not cleared by the agreed delivery day, we may reschedule delivery until payment is received. Where cash on delivery is the agreed method and no payment is offered on delivery, we may take the load away again and treat the order as cancelled, with a re-delivery / re-stocking fee equal to the standard delivery fee for your zone.
Firewood — what we sell.
The exact species mix varies through the year with the tree work we have been doing. We will tell you what is in the current load when you order. Firewood is sold by the cubic metre (m³) — the stacked-equivalent volume. Loose volume in the truck will be larger than the equivalent stacked volume.
Seasoning. We sell firewood that has been split and seasoned, and that is what we deliver where the product is described as such. If we have wood available that needs more drying time, we say so before you order, and you can decide whether to take it at a reduced price for seasoning at your own yard, or wait for fully dry wood.
Mulch — what we sell. Arborist mulch is a coarse, natural woody mulch made of chipped branch material from our tree work. It is a varied, natural product — species, texture and moisture content vary with the tree work we have on hand. The current stockpile may be fresh or partly broken down. We will describe what is available when you order.
Photos are indicative. Photos on the website show typical TB'S Trees firewood and mulch. The exact appearance of your load will vary with the current stockpile, species mix and time of year.
Before dispatch — no charge. You can change or cancel any order before we dispatch the load, by phone or email, at no cost. If you have already paid by bank transfer, we will refund any payment in full.
After dispatch. Once the truck has left for your address, we may not be able to cancel without a fee. A re-delivery / re-stocking fee equal to the standard delivery fee for your zone may apply if we have to bring the load back.
Cancellation by us. If we have to cancel — typically because expected stock did not come through — we will let you know as soon as possible and refund any pre-payment in full.
Changes to your order. You can ask to add to or change your order any time before dispatch. We will re-confirm prices and any change to the delivery fee or discount tier.
Bulk firewood and mulch are not returnable once delivered. Once a load has been tipped on your property, it cannot practically be returned to stock. This is normal for bulk landscape and firewood supply.
Genuine quality concerns. If you believe a delivered product is materially different from what was ordered and described — for example, firewood sold as seasoned that is clearly green, or a mulch load that is contaminated or significantly different from what was described — please contact us within 7 days of delivery. We will inspect or discuss the issue and, at our reasonable discretion, replace the product, supply a top-up, partly refund the price, or otherwise put it right.
Change of mind. We do not refund or replace for change of mind after delivery.
Nothing in this section limits your rights under the Australian Consumer Law — see Section 12 below.

Risk passes on delivery. Once the load is delivered to the address you nominated and dropped at the spot you agreed, the product is at your risk.
Storage and use of products. You are responsible for the storage and use of firewood and mulch on your property — including stacking, drying, fire safety in burning, and the appropriate use of mulch in your garden. Firewood is to be burned in compliance with any applicable local restrictions (for example, total fire ban days), and we accept no liability for use of firewood in breach of fire regulations.
Access risk. As set out in Section 5, where you have instructed us that access is suitable, you accept the ordinary risk of marks to driveways, lawns and other surfaces from a heavy delivery vehicle.
Limitation of our liability. Subject to Section 12 (Australian Consumer Law), our liability for any single order is limited to the price you paid for that order. We are not liable for indirect or consequential losses — for example, lost time, lost profit, lost amenity or distress.
Force majeure. We are not liable for delay or non-performance caused by events outside our reasonable control, including severe weather, bushfire, road closures, vehicle breakdowns, illness, or government direction. We will reschedule or refund as appropriate.
What we collect. When you place an order, we collect your name, phone number, email address, delivery address and the details of your order, including any delivery instructions.
How we use it. We use this information only to: take and confirm your order; deliver the order; communicate with you about the order; provide a receipt; and keep records as required for tax and business purposes.
Sharing. We do not sell or share your personal information with third parties for marketing. We may share information where required by law, with our accountant for tax and bookkeeping purposes, or with any payment processor where you have asked us to add card payments in future.
Retention. We retain order records as required by Australian tax and business record-keeping rules — typically 5 years from the date of the transaction.
Contact about your information. If you would like to know what information we hold about you, ask us to correct anything that is incorrect, or have your information deleted (subject to record-keeping obligations), contact us using the details in Section 14.
Cookies and the website. Our website uses standard browser features for the shopping cart (local storage on your device) so we can keep track of what you've added between pages. We do not run third-party tracking or advertising cookies on this website at this time.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits or excludes any non-excludable consumer guarantee, condition, warranty, right or remedy implied by the Australian Consumer Law.

We may update these Terms from time to time — for example, to reflect changes in our pricing structure, our delivery zones, the products we sell, or the law. The current version is always available at tbstrees.com.au/terms/ with the effective date shown at the top.
An updated version applies to orders placed after its effective date. Orders already confirmed at the time of an update are not affected — they remain governed by the version of the Terms in force when the order was confirmed.

These Terms apply to firewood and mulch product orders. Tree work (tree removal, lopping, pruning, stump grinding, hedge trimming and other arborist services) is quoted and contracted separately. For tree work bookings, the terms agreed in your written quote take precedence.
